Audit according to § 82b
of the Austrian Trade, Commerce and Industry Regulation Act

According to § 82b of the Austrian Trade, Commerce and Industry Regulation Act (‘Gewerbeordnung’) the owner of an operational facility is obligated to control or entrust somebody to check periodically, if it corresponds to the legal regulations. Therefore, depending on the facility, different periods are specified (5-6 years) and verification certificates are demanded, that particularly contain identified defects and suggestions and how they can be corrected. If such defects have been identified, the owner has to hand in a documentation of measures that have been taken to the removal of defects.

Even if the owner of an operational facility has passed an eco-audit according to EMAS or ÖNORM EN ISO 14001, the obligation according to
§ 82 is essential.

According to this regulation that became valid in 1994, every authorised company should have accomplished a corresponding audit for at least two times.
